Trust administration in North Carolina is different from estate administration. There are two main differences between these processes that you should be aware of, especially if you are just starting to think about planning your estate.
- Trust administration takes place in the privacy of your lawyer’s office, while estate administration is a public proceeding in the probate court.
- Trust administration occurs if you have some form of trust in place as part of your estate plan, whereas estate administration is the result of having merely a will in place, or possibly not even having a will in place.
But those aren’t the only differences, there are many other benefits to trust administration vs. going through estate administration or probate. Trust administration can happen much faster than probate, and there is much more flexibility in the process. In addition, trust administration can be much less expensive in terms of the overall cost to administer the estate.
